Synergy Workplace Wellbeing - Terms of Trade - 2023
Definitions:
SWW – (The Social Good Co Ltd T/A) Synergy Workplace Wellbeing
Your organisation – the legal entity to whom SWW provides service(s)
Workshop – SWW Workplace Wellbeing Workshop
Services:
For the Wellbeing Workshop fee stated on our website, SWW will provide a Workplace Wellbeing Workshop package which will include:
1. A pre workshop interview with a person or persons in management or other senior roles with authority to act on behalf of our organisation for the purpose of our work. The purpose of this meeting will be for SWW to tailor a workshop to best meet your organisation’s needs.
2. A two hour interactive workshop (in person or online).
3. Surveys of the two hour workshop participants to seek feedback and identify any opportunities for further wellbeing development within your organisation. Also participants will be invited to contact us to discuss any personal issues they would like to address.
4. A meeting of up to two hours with the persons outlined in point 1. to provide feedback from participant surveys, including any themes that were identified, and meet with participants for debrief or further feedback as time allows. Participants’ anonymity will be maintained.
5. A recommendation for further wellbeing development in your workplace and an outline of the costs of same. Upon request, SWW will also provide on a fee for service basis, services specifically to your organisation, such as:
1. Workplace wellbeing assessment and solutions.
2. Training for business owners, managers and team leaders in supporting employee wellbeing.
3. Individual education, support and therapy for employees.
4. Any additional services within the capacity of SWW to provide fees for these services will be outlined and accepted in writing before work commences.
People responsible for the work:
Suitably qualified SWW Wellbeing Educators will undertake all work.
Duty of care/rights
SWW has a duty of care to your employees who participate in a workshop or receive any other SWW service. This includes the psychological and physical safety of employees and reducing the risk of mental heal harm through the course of our work with your organisation. SWW will as far as is possible facilitate any additional mental health intervention, including emergency psychiatric services, for employees of your organisation who are in need of such. SWW code of rights are informed by the NZ Health and Disability Code of Rights.
As a user of SWW, your organisation and employees can expect SWW to uphold the following:
The right to be treated with respect.
The right to freedom from discrimination, coercion, harassment, and exploitation.
The right to dignity and independence
The right to services of an appropriate standard.
The right to effective communication.
The right to be fully informed.
The right to make an informed choice and give informed consent.
The right to support.
Rights in respect to teaching or research.
The right to complain.
The right to receive services to a high professional standard.
SWW is committed to continuous quality improvement, and welcome all feedback in the interests of improving service delivery.
Prices/fees/quotations/acceptance
All fee for service services will be quoted by the hour or as a package, depending on the nature of the service. It will not always be possible for SWW to provide exact quotes for services that do not have a predictable timeframe.
All prices/fees will be quoted exclusive of GST.
Fee for service quotes will be valid for 30 days.
Acceptance of quotes will be in writing.
Terms and conditions specific to each service (and not covered in the Terms of Trade) will be clearly
outlined in the quote for the service.
Payment/late payment/default payment:
Payment for fee for service services will be due 7 days from the completion of the service, or as per the agreed terms and conditions for specific services, unless otherwise agreed between SWW and your organisation. SWW reserves the right to suspend ongoing services for late or non-payment until payment or any amount owing is made full or a payment arrangement agreed upon. Any costs associated with the collection of unpaid fees will be met by your organisation.
SWW reserves the right to cancel subsequent services until payment for previous services is made in full.
If your organisation cancels an arranged and scheduled SWW workshop or other service within 48 hours of the arranged time, SWW reserves the right to retain 50% of any fees already paid. In cases where a workshop or other service has been arranged between SWW and your organisation, your organisation will be invoiced 50% of the agreed upon fee if cancellation is made within 48 hours.
SWW will invoice your organisation the full fee in cases of non-attendance without notice by your employees.
If cancellation of a workshop or other service is needed due to factors outside of the control of either party, the workshop or service will be rescheduled at the earliest convenience for your organisation at no additional cost. If it is not possible or feasible to reschedule within 60 days of the original dates, SWW will refund in full any fees already paid by your organisation minus the hours spent in preparing and customising your workshop.
Privacy/confidentiality/retention of documents:
SWW will uphold the privacy of your organisations’ employees and will not disclose any details pertaining to the operation, intellectual property, financially sensitive material that SWW staff may become aware of in the course of our work with your organisation.
Your organisation understands that there are conditions on confidentiality, namely:
1. There is an imminent risk of harm to or by a person or persons within your organisation. This includes risk of harm to self or others.
2. A criminal offence has been, is being, or is about to be committed.
SWW staff are highly competent in risk assessment, and where possible will raise any concerns with the appropriate person or persons in your organisation. Where necessary, SWW staff will notify the relevant authorities (e.g. Police, Emergency Psychiatric Services, Oranga Tamariki)
Dispute resolution:
Any disputes between SWW and your organisation will be dealt with in the first instance by representatives nominated by each party. SWW staff will attempt to resolves disputes, however if no resolution can be readily agreed upon, SWW may chose to engage a consult at SWW’s cost.
Electronic communication:
SWW will agree the means of communication with your organisation, with the intention of meeting your organisation’s wishes and requirements. SWW take all reasonable steps to ensure security of electronic communications and data, however recognise that email communication is not 100% secure.
Conflict of interest:
SWW and your organisation will disclose to each other any actual or potential conflicts of interests in relation to the work being agreed upon and undertaking.
Warranty/limit of liability:
SWW offers a warranty on all services in so far as they will be delivered in accordance to best practice standards by suitably qualified and supervised professionals. Your organisation acknowledges each individual employee will respond in their own way to SWW content and mode of service delivery, however SWW will endeavour to identify any potential challenges due to human nature or personality and devise solutions to those challenges.
